Tanzania’s billionaire Rostam Aziz has overcome a significant legal obstacle in Kenya following a High Court decision permitting him to advance with a $124 million liquefied petroleum gas facility at the port of Mombasa. The ruling removes previous limitations on building and permits Taifa Gas, his LPG enterprise, to resume work on a 30,000-tonne storage facility intended for the Dongo Kundu Special Economic Zone.

The Environment and Land Court dismissed a petition submitted by two Likoni residents aiming to halt the project on environmental grounds. Their case had temporarily impeded advancement on the terminal. The court stated that the issues including coral outcrops, adjacent vegetation, fishing areas, and water quality had previously been examined by the National Environmental Tribunal. The judge observed that any contestation about an Environmental Impact Assessment license should be addressed to that tribunal instead of via a constitutional petition. The verdict indicated that there was no basis to criticize the approvals acquired for the LPG plant.
